Porn peddlar defends video

A local porn performer at the centre of a sex-video scandal involving two courthouse sheriffs says her co-stars knew full well their bedroom antics might end up on the Internet, according to court documents.

Jacqueline Burgoyne and Rick Gordon filed a lawsuit last month claiming they were drunk when they signed a waiver allowing the interlude to be recorded and did not know it would be posted on the Internet.

Not so, Oshean and her husband, Johannes de St. Clair de Guise, say in a statement of defence filed in court this week.

The couple claim they met Burgoyne and Gordon just hours before recording the video, at which time the couple discussed "a desire of being introduced to the business of making reality video recordings of sexual activities."

Sex Scenes

Prior to filming the sex scenes, the couple was told they would have to sign a consent form authorizing the video to be displayed on Oshean's website for a profit, says the statement of defence. The consent form reads in part: "I am at least 18 years of age and eligible to participate in adult photo/video production for commercial purposes."

"Our position is they freely consented and knew what was going to happen when the video was shown," said Oshean's lawyer, David Guttman.

In an affidavit filed earlier this month, Burgoyne said she believed the video was recorded only for the personal use of both couples. Burgoyne and Gordon claim they have suffered humiliation and embarrassment and their privacy was violated.

Burgoyne and Gordon were suspended by Manitoba Justice on Dec. 28 after word spread of the video. The pair was reinstated Jan. 8 and immediately went on stress leave. They returned to work last week.

Last month, Oshean temporarily removed the offending video after the couple filed a motion asking for its removal from Oshean's website. A hearing to decide whether the video should be permanently removed will be held next month.
